Terms & conditions

Please read the following information thoroughly and carefully. It constitutes a binding agreement between 1) the “Lead Client” i.e the person named in all e-mails and documentation who has booked the holiday described for himself/herself and other members/clients of his/her party as per the Final Itinerary, Booking Form and Invoice. and 2) the “Company/Tour Operator” i.e SheherazadVentures sarl, registered in Marrakech, Morocco under Patente No. 64290060

The Terms and Conditions quoted here are in effect immediately upon the receipt of your Booking Deposit or Full Payment (if booking less than 30 days before start of tour).

The Agreement:

The Terms and Conditions set forth in this agreement constitute the entire understanding and agreement between SheherazadVentures sarl and any or all of the additional “Clients/Passengers” named on the Booking Form with respect to any and all tour bookings or transactions made with SheherazadVentures Sarl.

By submitting a Booking Deposit or Full Payment, the Lead Client and any and all those whom the Lead Client represents in their group, regardless of age or association, accept all of the terms in this agreement and directs SheherazadVentures Sarl to provide services for you and your groups behalf. All persons included in this booking are “Clients/Passengers” and are subject to this agreement. By paying your deposit, you affirm that you have made all other Clients/Passengers in your group aware of these terms and that all members of your group accept these terms.

Reservations: You may reserve a private Morocco tour with SheherazadVentures sarl by making a Non-refundable Booking Deposit payment once the draft final itinerary has been agreed via e-mail and an Invoice has been issued. A booking is not however final until SheherazadVentures Sarl receives full payment for the tour as defined in the Payment Schedule on the Invoice. The balance must be paid no later than 30 days prior to departure. Any delay can result in cancellation by us of all services, with your deposit being withheld by us, or loss of your preferred named accommodations.

Deposits and Payments: A non-refundable deposit of
 25% of the agreed final quoted tour price is required at the time of booking. At this stage an Invoice will be issued in the name of the Lead Client for the full tour amount and with details of Payment Methods and Payment Schedule. Final payment of any balance outstanding is due 30 days before the first day of your tour.

Day tours: 100% payment in advance is required at the time of booking. At this stage an invoice will be issued in the name of the Lead Client for the full day tour amount and with details of Payment Methods.

Late Bookings: For tour bookings requested within 30 days of start date, 100% of the full tour price is payable in order to secure the reservation.

Last Minute Payments: If booking a tour within 5 days of departure full payment must be made in full using PayPal (5% surcharge) or 25% deposit via PayPal (5% surcharge) and balance of 75% in cash (dirhams) to our representative at start of tour.

Pre-Departure Documentation: When your tour booking is confirmed the Lead Client will receive the following documentation:
a) Booking Form, b) Invoice, c) Final Itinerary It is important that you carefully read all trip-related documents as soon as you receive them. It is the Lead Client’s responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies in those documents.

Cancellation Policy:

Cancellations made by You: If you wish to cancel your booking for any reason once payment (whether the Booking Deposit or full amount) has been made, then notice must be given via e-mail immediately. The date that the e-mail is received will be the date used for calculating cancellation fees.

If you decide to cancel your trip completely, you must notify us in writing and the following refund system will apply: Cancellation of holiday prior to 60 days of start = full refund of monies paid (excl. Booking deposit) Cancellation between 30-60 days of start = 50% of monies paid refundable (excl. booking deposit) Cancellation between 0-30 days of start = no refund 


If you have to cancel your tour, you may opt to defer your trip to a later date (within a year) and any deposit payments will be held over as credit towards your next booking.

Changes to your Booking: Once a Final Itinerary and Invoice have been issued, then no changes can be made to the booking without incurring an Administration Fee (variable fee subject to the complexity of the changes). We will endeavor to make changes if there is sufficient notice given.

Once a tour is underway, no changes can be made unless a situation beyond our normal control requires it e.g. problem with an accommodation supplier, local weather or road conditions, illness of client or any situation where it is deemed unsafe to follow the Itinerary.

If you wish to add extra activities within a 24 hour period to your itinerary then this may be possible depending on the time available within the daily programme.

You may add extra people to your booking (at any stage) subject to availability of rooms at hotels that have already been reserved and subject to seats available in the vehicles which will have been priced as part of your original Tour Price. The extra cost will have to be paid immediately and a revised Invoice for the full tour cost will be sent to the Lead Client.

Changes or Cancellations made by Us Occasionally changes may be made to your tour for which we reserve the right to do so at any time. This may be due to seasonal conditions that may involve a diversion of route or the cancellation of some stages. In most cases these will be minor. We cannot be held legally responsible if we are forced to cancel, or in any way change your tour due to reasons beyond our personal control, including injury or delay due to sickness, machinery breakdown, war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions.

CORONAVIRUS COVID-19 CANCELLATION & POSTPONEMENT POLICY (effective from March 10th 2020)

Exceptional and unprecedented global health circumstances have forced us to review our cancellation policy for the period from March 2020 through till October 2020 when we hope the situation will have resolved.

CANCELLATION & DEPOSITS:

Our Cancellation Policy is that 25% deposit is non-refundable in ALL circumstances and has to be paid at time of booking OR no later than 60 days before arrival. Balance of payment for a holiday is due not later than 30 days in advance of arrival.

If a trip has to be cancelled due to Coronavirus fears or due to WHO/FCO/government advice not to travel to Morocco, then we cannot refund any deposit received.

If the trip is due to start in between 60 days – 30 days time and has been fully paid for, then we may be able to partially refund any monies paid in advance (excluding the deposit) but dependent on local suppliers own cancellation policies and flexibility. We will decide case-by-case what is possible but where cancellation is due to circumstances beyond our control, then we are not obliged to give any refund.

Any trip due to start in less than 30 days and fully paid is non-refundable.

CORONAVIRUS POSTPONEMENT POLICY

If a client wishes to POSTPONE their booking and have pre-paid either their 25% deposit or paid in-full, then we can only do this on a case-by-case system, and if there is over 30 days notice AND ONLY if the local suppliers, guides, transport companies, hotels etc have availability for the newly selected dates. The amount paid to SheherazadVentures will be held in credit for the customer, but the final trip price might vary from the original price quoted depending on seasonal variations, currency fluctuations and availability of selected accommodation. There will also be a service/admin charge of 10% on the revised tour price to postpone/defer. Trips cannot be deferred to High Season periods (Christmas/New Year/Easter). Maximum 12 months postponement from original trip departure date.

WE STRONGLY ADVISE ALL CUSTOMERS TO PURCHASE TRAVEL INSURANCE TO COVER CANCELLATION AND TRAVEL DISRUPTION AT TIME OF BOOKING THEIR HOLIDAY

Responsibilities:

Lead Client/Clients Responsibilities: It is Lead Clients (and Clients) responsibility to be ready to embark on the tour as specified in the Final Itinerary. SheherazadVentures sarl is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures. We will do our utmost to accommodate any unexpected changes and keep as close to the original itinerary as possible. However this may result in extra costs to the Lead Client if e.g. extra hotel rooms, extra transportation, transfers or other services are required to get the tour itinerary back on track. The Lead Client agrees to pay for any additional costs incurred in such an event. This payment will be required in cash on arrival or via PayPal with a credit card (5% surcharge).

It is the Lead Clients responsibility to make sure that all members of his/her party have valid Immigration documents and passports etc. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation.

While SheherazadVentures sarl may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, SheherazadVentures sarl is not responsible for any errors or omissions as to the information provided.

It is the Lead Clients responsibility to make sure that all members of his/her party have advised SheherazadVentures sarl of any medical condition/dietary requirements/allergies or any issue that might affect the safe running of the tour, via the Booking Form.

It is the Lead Clients responsibility to furnish SheherazadVentures sarl with details of Travel Insurance for every member of his/her party via the Booking Form.

It is the Lead Clients responsibility to ensure that all flight arrival times and departure times are correct at time of travel and that SheherazadVentures sarl is updated with any schedule changes.

Compliance with Local Laws and Tour Etiquette: Clients must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local driver, guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others.

Our Responsibility: SheherazadVentures sarl agrees to organise, deliver and manage the tour and associated services, guides, transportation, accommodation, meals and activities as defined in the Final Itinerary document that has been agreed between the Lead Client and the office of SheherazadVentures sarl.

SheherazadVentures sarl agrees to pay all the local suppliers and staff costs related to the delivery of the tour. No extra charges will be expected of the client other than those identified in the Final Itinerary (tips, drinks, some meals etc).

SheherazadVentures SARL acts only as an intermediary for the various independent suppliers that provide accommodation, meals, transportation, sightseeing, activities or other goods and services. Clients acknowledge that they are aware and clearly understand that these Suppliers are independent contractors, are not managed by SheherazadVentures sarl, and are not agents or employees of SheherazadVentures.

Complaints:

If Clients have a complaint or problem during the tour, they must promptly notify the tour assistant or driver so that they can attempt to remedy the situation in situ. If the tour assistant cannot resolve a problem then he will refer to the office of SheherazadVentures sarl for an acceptable solution. Travelling in Morocco can be unpredictable and Clients must take responsibility to be aware of any potential hazards or situations. Clients must also take guidance from our tour staff.

Disclaimer:

Lead Client/Clients agree to release SheherazadVentures sarl from any negligence arising from the services of our Suppliers or any 3rd party negligence, and that Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of Morocco. SheherazadVentures sarl is not responsible for a Supplier’s delay, cancellation, overbooking, strike, negligence or any variable circumstances that arise causing injury or inconvenience of any kind. We do our best to make your stay a safe one and alert you to any dangers, but SheherazadVentures sarl, its directors, staff and any external sales agents are not liable for any personal accidents, injuries claims or loss of property whether experienced through services and activities organised by us, or delivered by one of our transport, accommodation or activity third party suppliers.

Force Majeure:

Force Majeure means any circumstances beyond the reasonable control of SheherazadVentures sarl, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, animals, plants, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances, or actions or decisions by individuals. SheherazadVentures sarl will not be deemed in breach of this agreement or otherwise liable to Lead Client/Clients, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. If SheherazadVentures sarl and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour. After SheherazadVentures sarl has investigated the prevailing situation, as it deems fit, it shall remain in SheherazadVentures sarl sole and absolute discretion whether to proceed with the tour.

Travel Insurance:

Adequate and valid travel insurance is a obligatory when booking a tur with SheherazadVentures sarl. All clients are required to purchase adequate comprehensive travel insurance to cover accidental death, accidental injuries, medical expenses, illness (including any related to pre-existing medical conditions), emergency repatriation (helicopter or air ambulance where it is available). We also recommend obtaining insurance to cover cancellations, curtailment, loss of luggage and/or personal belongings such as cameras, passports and valuables. It is the Clients responsibility to make sure you are insured for all activities you wish to undertake during your holiday. Remember that some of the activities you will be undertaking with SheherazadVentures sarl are often outside the remit of normal travel cover - e.g. camel-trekking, sand-boarding, quad-biking, hot-air balloon rides, desert trekking, surfing, mule-trekking, horse-riding, rock-climbing etc. Clients may purchase insurance through our preferred provider World Nomads, who will cover travellers from most countries and who also cover a very broad range of adventure activities which are normally outside of standard travel policies. If you decide not to use our preferred provider, we assume you are securing protection through another insurance company of your choosing.

You will be asked to supply us with details of your Travel Insurance on your Booking Form as well as their Emergency Contact Number.

If you choose to travel without insurance you travel ENTIRELY at your own risk without any recourse to SheherazadVentures sarl for assistance that may be required, or any form of compensation in the event of an incident.

Applicable Law and Choice of Forum:

Any dispute arising out of this agreement by any or all Lead Clients/Clients and their respective heirs, legal personal representatives, successors shall first be taken to arbitration in the location of SheherazadVentures sarl choice, before litigated and determined, if at all, and only before a court of competent jurisdiction in Marrakech, Morocco (and in no other).

Privacy & Data Protection:

We never disclose personal information like names, passport numbers, birth dates, addresses, telephone numbers, emails or website addresses, or any other information used to identify individuals to any third parties for any reason. We solely use this information for our own records in case of emergency matters while you are travelling with us in Morocco.

Images Release: Clients agree that SheherazadVentures sarl may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travellers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images that are taken by us or other participants during the tour, you must inform us, or your tour leader in writing at the start of the tour.

SheherazadVentures sarl is not liable for any unlawful disclosure of any personal information obtained by outside sources or computer hacking.

Updating of Terms and Conditions:

SheherazadVentures Sarl reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the SheherazadVentures website.
